Registration Violations

No/Expired Numbers -G.S. 75A-4:  (operate) (give permisstion to ___________ to operate) a vessel on the waters of this State (which is not numbered under an approved numbering system) (with a certificate of number that is not in full force and effect). $35 & costs.

Failure to Carry Registration - G.S. 75A-5(a): operate a vessel on the waters of this State without having available the registration card for inspection. $25 & costs.

Equipment Violations

PFD's - G.S. 75A-6: (operate) (give permision to __________ to operate) a motorboat on the waters of this State [without] or [with an insufficient (number) (type) (size) of] or [without readily accessible] lifesaving devices. $35 & costs.

PFD under 13 YOA - G.S. 75A-6:  operate a recreational vessel underway on the waters of this State with a child under 13 years old onboard who is not below decks or in an enclosed cabin and is not wearing an approved PFD.  $35 & costs.

Fire Extinguisher - G.S. 75A-6: (operate) (give permission to __________ to operate) a motorboat on the waters of this State without having [wthe correct (type) (size) of] or [in good working condition a] fire extinguisher capable of promptly and effectively extinguishing burning gasoline.  $35 & costs.

Sound-Signaling-Device - G.S. 75A-6.1: (operate) (give permission to __________ to operate) a vessel on the waters of this State without an adequate sound-signaling device.  $35 & costs.

Lights - G.S. 75A-6.1: (operate) (give permission to __________ to operate) a vessel on the waters of this State between the hours of sunset and sunrise without the proper lighting or equipment.  $35 & costs.

Boat Liveries - G.S. 75A-8:  rent a vessel to another without the required equipment, to wit: (specify equipment). Strike "operate".  $25 & costs.

Muffler - G.S. 75A-9: operate a motorboat on the waers of this State (without effective muffling equipment) (wihle using cutouts).  Mandatory Appearance.

Operations Violations

Failure to Stop for Blue Lights - Chapter 356, Session Laws 1983: operate a vessel on the waters of this State and fail to stop for a blue light or siren exhibited by a law enforcement officer during the performance of his duties.  Mandatory appearance.

Hit and Run - G.S. 75A-11(a): as the operator of a vessel involved in a collision failed to [render assistance to persons affected by the collision] or [give his name, address, and identification of his vessel in writing to (an injured person) (the owner of property damaged in the collision)]. Mandatory appearance.

Litter or Sewage Discharge - G.S. 75A-10(c): (place) (throw) (deposit) (discharge) or (cause to be placed, thrown, deposited, discharged) (onto the waters of this State) or (into the inland lake waters of this State) (litter) (raw sewage) (bottles) (cans) (papers) (liquid or solid materials that would render the waters unsightly or noxious). Stirke "operate".  Mandatory appearance.

Tying to Markers - 15A NCAC 10F.0301: tie a vessel on the waters of this State to a waterway marker other than a morring buoy.  $25 & costs.

Reckless Operation - G.S. 75A-10(a): (operate a motorboat or vessel) (manipulate water skies, surfboard or similar device) on the waters of this State in a reckless or negligent manner so as to endanger life, limb, or property.  Mandatory appearance.

Boating While Imparied (BWI) - G.S. 75A-10(b1):  (operate a motorboat or motor vessel) on the waters of this State (while under the influence of an impairing substance) (after having consumed sufficient alcohol to have an alcohol concentration of .08 or more).  Mandatory appearance.

Move Over (Waterway) 75A-17(f)):  (operatoe a motorboat or vessel) on the waters of this State when passing within 100 feet of a law enforcement vessel that is displaying a flashing blue light (Unless the vessel is in a narrow channel.  Vessels operated on the waters of this State in a narrow channel shal slow to a no-wake speed when passing within 50 feet of a law enforcement vessel that is displaying a flashing blue light.) A person who violates this subsection is guilty of a Class 3 misdemeanor.

Skiing Operation

Skiing While Impaired - G.S. 75A-10(b): manipulate water skis, surfboard, nonmotorized vessel or similar device on the waters of this State while under the influence of an impairing substance.  Mandatory appearance.

Skiing Responsibilities - G.S. 75A-13(a):  operate a vessel on the waters of this State and tow any person(s) on water skis, surfboard or similar device without (a person, in addition to the operator, in a position to observe the person(s) being towed) (without the boat being equipped with a rearview mirror). [Unless the person being towed has on a PFD]. $35 & costs.

Skiing Responsibilities (local-PFD): (operate a vessel while towing a person on water skis or similar device without that person wearing) or (while being towed on water skis or similar device not wearing) a PFD of 50 mph impact class on the waters of (Lake Norman) (Mt. Island Lake) (Lake Wylie).  (Respective Lake Commission Consolidated Motor Boating and Personal Watercraft Regulations).  Mandatory appearance.

Skiing Time - G.S. 75A-13(b):  operate a vessel on the waters of this State towing a person(s) on water skis, surfboard or similar device between the hours from one hour after sunset to one hour before sunrise.  $35 & costs.

PWC Operation

PWC Laws - G.S. 75A-13.3  All are $35 & costs.
(a) Time: operate a PWC on the waters of this State between the hours of sunset and sunrise.
(a1) Operating at Greater than No-Wake Speed:  operate a PWC on the waters of this State at greater than no-wake speed withink 100 feet of (anchored or moored vessel) (dock) (pier) (swim float) (marked swimming area) (swimmers) (surfers) (persons engaged in angling) (manually operated vessel).
(b) Age: knowingly allow ________ to operate a PWC on the waters of this State, such person being under the age 16 and not having completed an approved boaters safety course.  [Ages 14-15, or they were 12 yoa prior to Nov. 1, 2005 ok if completed course and have proof].
(c)Livery: lease, hire or rent a PWC to or for oepration by a person under 16 years of age.
(d)(1)PFD's: (operate) or (knowingly allow another person to operate) on the waters of this State a PWC without each person riding on or being towed behind such vessel wearing an approved PFD.
(d)(2) Lanyard: (operate) or (knowingly allow another person to operate) on the waters of this State a PWC without the lanyard attached to the person, clothing or flotation device of the operator.
(d1(1) Pulling Skier:  operate a PWC on the waters of this State while towing a person on water skis or other devices without (having an observer on board) (the PWC being equipped with a rearview mirror).
(d1)(2) Number of Occupants:  operate a PWC on the waters of this State when the total number of persons on board and being towed exceeds the maximum safe load identified by the manufacturer.
PWC - Reckless Operation - G.S. 75A-10(a):  operate a PWC on the waters of this State in a reckless or negligent manner so as to endanger life, limb or property.  [Under G.S. 75A-13.3(e), this includes weaving through congested vessel trafic; jumping the wake of another vessel within 100 feet of such vessel or when visibility around such vessel is obstructed; intentionally approaching another vessel in order to swerve at the alst possible moment to avoid a collision; and, proceeding in the same direction and operating at a speed in excess of 10 miles per hour when approaching within 100 feet to the rear or 50 feet to the side of another vessel that is underway].  Mandatory appearance.

Boating Access and Parking Violations

Blocking Ramp - 15A NCAC 10E.0004(a). [G.S. 113-264(a)]: Leaving any vehicle, boat, or other object on boating access to impede use of area.  $35 & costs.

No Parking - 15A NCAC 10E.0004(a) [G.S. 113-264(a)]:  Parking in a no parking zone in boating access area.  $50 & costs.

Boating Access Misuse - 15A NCAC 10E.0004(a). [G.S. 113-264(a)]:  Using a boating access area for purpose other than the launching of boats and parking vehicles.  $50 & costs.

Boating Access No Wake - 15A NCAC 10E.0004(d):  operate a motorboat on the waters of this State within 50 yards of Wildlife Commission (owned or managed) boat launch ramp at greater than no wake speed.  $35 & costs.

Waters of Lake Norman

No Wake - G.S. 75A-14.1:  operate a vessel at greater than no wake speed within 50 yards of a (boat launching area) (bridge) (dock) (pier) (marina) (boat storage structure) (boat service area) on the waters of Lake Norman $35 & costs.

Blue Herring Island - 15A NCAC 10J.0102:  trespass on a colonial waterbird nesting area.  $10 and costs.

No-Wake in Marked Coves - 15A NCAC 10F.0307:  operate a motorboat at greater than no-wake speed in describe cove. (cove north of the inlet of Hagers Creek, Vineyard Point cove, Jetton park cove, Blythe landing cove).  $35 & costs.

Charter Boat Ordinance - LNMC Ordinance:  operate a vessel on the waters of Lake Norman in violation of Section 5 of the Lake Norman Marine Commission Charter / Excursion Boat Regulations, to wit, by describe violation.  Mandatory appearance.

 Rafting Ordinance - LNMC Ordinance:

• raft eleven or more vessels together closer than 300 yards from the main shoreline of Lake Norman; or
• raft three or more vessels together closer than 100 yards from the main shoreline of lake Norman; or
• raft 1 or 2 vessels within 100 yards from the main shoreline of lake Norman but not at least 50 yards from any other vessel or group of vessels rafted or anchored together; or
• raft 3 to 10 vessels within 300 yards of the main shoreline of lake Norman but not at least 200 yards from any vessel or group of vessels tied or anchored together

in violation of the Lake Norman Marine Commission Rafting Safety Ordinance. Mandatory appearance.
